Stock Artists Alliance Once Again Questions

Two years ago the Stock Artist Alliance (SAA) (www.stock artistsalliance.org), a coalition of visual artists, opposed the Orphan Works Act of 2006, which gave museums and publishers the ability to publish, without fear of liability, photographic works for which they could not find the copyright holder. The proposed legislation was defeated. Two years later reworked versions of the same legislation (H.R. 5889, Orphan Works Act of 2008 and S.2913, Shawn Bentley Orphan Works Act of 2008) are once again being considered by Congress. As in 2006, the concern of the SAA is that Orphan Works legislation must not endanger the copyright protections now guaranteed to artists. Unfortunately, from the SAA’s point of view, the current bills still include several elements that invite abuse.
